Build of the WeekTerms of Service

By accessing and using the Build of the Week application ("the Service") operated by ACS Composite ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
You must be at least 13 years of age to use this Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
To access certain features of the Service, you must create an account through Shopify authentication. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate and complete information
- Updating your information to keep it current
- Notifying us immediately of any unauthorized use
By submitting content to the Service, including build information, photos, and descriptions, you:
- Grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content
- Represent that you own or have the necessary rights to the content
- Warrant that your content does not infringe on any third-party rights
- Acknowledge that we may moderate or remove content at our discretion
5.1 Submission and Consent
By submitting your vehicle's photos and details to our "Build of the Week" feature (referred to as "Submission"), you grant ACS Composite a non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute your Submission on our website, in advertisements, product pages, and marketing materials. Your Submission may be publicly showcased and used for promotional purposes.
5.2 User Representations and Warranties
You affirm that:
- You hold all necessary rights to the Submission or have obtained appropriate permissions from the rights holders
- The Submission does not infringe on any third-party intellectual property or privacy rights
- All provided information is accurate and truthful
5.3 Privacy and Personal Information
Your personal information included in the Submission will be treated in accordance with our Privacy Policy. We will not share your personal information without your explicit consent, except as needed for the intended purposes or as required by law.
5.4 Right to Withdraw Consent
You may withdraw your consent for future use of your Submission by contacting us. We will cease using your Submission for new purposes and will attempt to remove it from current uses where feasible. However, removal from previously distributed materials may not be possible.
5.5 Age Requirement
Submitters must be of legal age as per the jurisdictional laws. If you are a minor, a parent or legal guardian must consent to the submission.
5.6 Discretionary Use
Submission does not guarantee feature as "Build of the Week." ACS Composite reserves the right to select and modify Submissions at its discretion.
5.7 Indemnification
You agree to indemnify ACS Composite against any claims arising from your Submission, including but not limited to infringement of third-party rights.
5.8 Amendments to Terms
ACS Composite may revise these terms at any time. Continued participation in "Build of the Week" after such changes indicates your agreement to the revised terms.
You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Post content that is offensive, defamatory, or infringes on others' rights
- Impersonate any person or entity
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any portion of the Service
- Use automated scripts to collect information or interact with the Service
- Harass, abuse, or harm other users
- Submit false or misleading information
The Service and its original content (excluding user content), features, and functionality are owned by ACS Composite and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
When making purchases through the Service:
- All transactions are processed through Shopify's secure payment system
- Product availability, pricing, and specifications are subject to change
- Orders are subject to acceptance and availability
- Shipping, returns, and refunds are governed by ACS Composite's policies on acscomposite.com
- You agree to provide accurate billing and shipping information
The Service may contain links to third-party websites or services that are not owned or controlled by ACS Composite. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACS COMPOSITE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
You agree to indemnify, defend, and hold harmless ACS Composite and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your content, or your violation of these Terms.
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which ACS Composite operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ACS Composite regarding the use of the Service and supersede all prior agreements and understandings.
